These Terms of Service ("Terms") govern your use of the Paintiano web application available at paintiano.app (the "Service") and any purchase of the Paintiano Pro license (the "License").
By using the Service or purchasing the License you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Service.
The Service is operated by:
Registered with the Slovak Trade Licensing Register; supervising authority is the District Office in the place of business.
The Service is freely accessible. Anyone may use Paintiano in their browser to convert musical input (MIDI files, audio, microphone input, or AI-generated mood prompts) into generative paintings, and to export those paintings as images. The free tier includes reasonable usage caps to manage server costs.
Paintiano offers two one-time, lifetime paid licenses — Paintiano Pro and Paintiano Pro AI. Both unlock premium features in the Service for the lifetime of the product. Pro includes (but is not limited to):
Pro AI includes everything in Pro and additionally unlocks unlimited AI composition — from text, from your images, and AI atmospheric tinting.
Each License is delivered electronically as a license key, sent by email immediately after payment is confirmed by our payment processor. You activate a License inside the Service by entering this key.
"Lifetime" means for as long as Paintiano remains operational as a service. We do not guarantee any minimum operational period, but we will give reasonable advance notice if we ever discontinue the Service.
Prices are shown in EUR and include any applicable taxes that our payment processor is obliged to collect.
Payments are processed by our payment provider, Paddle.com Market Limited, acting as Merchant of Record. By purchasing the License, you also agree to Paddle's Checkout Buyer Terms.
Your purchase invoice is issued by Paddle and delivered by email together with your license key.
You may request a full refund within 14 days of purchase, for any reason, in line with EU consumer law (Directive 2011/83/EU). To request a refund, email hello@paintiano.app from the address used to purchase, or contact Paddle support directly. Refunds are usually processed within 5 business days back to the original payment method.
Because Paintiano Pro is digital content delivered immediately, your statutory EU right of withdrawal may end earlier than 14 days once delivery begins and you have consented to immediate access at checkout (see Paddle’s Checkout Buyer Terms). Regardless of this, Paintiano voluntarily offers a full 14-day refund to every customer.
After a refund the associated license key is deactivated and Pro features in the Service are turned off on the next online session.
You agree not to:
We may suspend or terminate your access if you materially breach these Terms.
You retain full ownership of any musical input you upload and of any painting Paintiano generates from your input. We claim no rights over your creations.
You are responsible for ensuring you have the right to use any input you upload (for example, you should not upload a MIDI file you do not own or have a license for).
The Paintiano name, logo, source code, and visual design remain the intellectual property of the operator.
Some features (notably "Mood" and "Mood from image") use third-party AI models to compose music. The output is generated automatically and may occasionally be unexpected, imperfect, or inconsistent with the input. AI compositions are provided as-is. We do not warrant that any specific output will be created for a given prompt or image.
We provide the Service on a best-effort basis. We may modify, suspend, or discontinue parts of the Service to fix bugs, add features, or for operational reasons. Brief planned or unplanned outages may occur. The Service is provided "as is", without warranties of any kind beyond those required by mandatory consumer law.
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service or the License is limited to the amount you paid us for the License in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages (such as lost profits or lost data).
Nothing in these Terms limits liability for fraud, gross negligence, or where liability cannot be limited by law (including statutory consumer rights).
We collect minimal data: license keys we issue, your activation email (from Paddle), basic usage analytics (anonymous), and any support correspondence you send us. We do not sell your data. AI features send your prompt (or low-resolution image) to our AI provider for inference only and do not store identifying personal data on those endpoints.

We may update these Terms from time to time. The "Effective" date at the top will be updated. Material changes affecting your rights will be communicated by email (if we have your email) or via a banner inside the Service. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Slovak Republic. Where you act as a consumer, you also retain any rights that mandatory consumer protection law in your country of residence gives you.
Disputes will first be addressed through good-faith communication. If unresolved, disputes may be brought before the competent Slovak court, or — for consumer disputes — through the EU Online Dispute Resolution platform.

Der Dienst ist frei zugänglich. Jeder kann Paintiano im Browser nutzen, um musikalische Eingaben (MIDI-Dateien, Audio, Mikrofon oder KI-generierte Stimmungs-Prompts) in generative Gemälde zu verwandeln und diese als Bilder zu exportieren. Die kostenlose Version enthält angemessene Nutzungsgrenzen zur Verwaltung der Serverkosten.
Paintiano bietet zwei einmalige Lifetime-Lizenzen — Paintiano Pro und Paintiano Pro AI. Beide schalten Premium-Funktionen für die Lebensdauer des Produkts frei. Pro umfasst (aber nicht beschränkt auf):
Pro AI umfasst alles in Pro und schaltet zusätzlich unbegrenzte KI-Komposition frei — aus Text, aus Ihren Bildern und atmosphärische KI-Tönung.
Jede Lizenz wird elektronisch als Lizenzschlüssel zugestellt, per E-Mail unmittelbar nach Zahlungsbestätigung. Sie aktivieren eine Lizenz im Dienst durch Eingabe dieses Schlüssels.
„Lebensdauer" bedeutet so lange Paintiano als Dienst betrieben wird. Wir garantieren keinen Mindestbetriebszeitraum, werden aber angemessen im Voraus informieren, falls wir den Dienst einstellen.
Preise werden in EUR angezeigt und enthalten alle anwendbaren Steuern, die unser Zahlungsabwickler einziehen muss.
Zahlungen werden von unserem Zahlungsanbieter Paddle.com Market Limited als Merchant of Record verarbeitet. Mit dem Kauf der Lizenz stimmen Sie auch Paddles Checkout-Käuferbedingungen zu.
Ihre Kaufrechnung wird von Paddle ausgestellt und zusammen mit Ihrem Lizenzschlüssel per E-Mail zugestellt.
Sie können innerhalb von 14 Tagen nach dem Kauf aus jedem Grund eine vollständige Rückerstattung beantragen, im Einklang mit dem EU-Verbraucherrecht (Richtlinie 2011/83/EU). Senden Sie dafür eine E-Mail an hello@paintiano.app von der zum Kauf verwendeten Adresse, oder kontaktieren Sie den Paddle-Support direkt. Rückerstattungen werden in der Regel innerhalb von 5 Werktagen auf die ursprüngliche Zahlungsmethode bearbeitet.
Da Paintiano Pro digitaler Inhalt ist, der sofort bereitgestellt wird, kann Ihr gesetzliches EU-Widerrufsrecht früher als 14 Tage enden, sobald die Bereitstellung beginnt und Sie an der Kasse der sofortigen Bereitstellung zugestimmt haben (siehe Paddles Checkout Buyer Terms). Unabhängig davon bietet Paintiano jedem Kunden freiwillig eine volle 14-tägige Rückerstattung.
Nach einer Rückerstattung wird der Lizenzschlüssel deaktiviert und Pro-Funktionen bei der nächsten Online-Sitzung abgeschaltet.
Sie verpflichten sich, Folgendes zu unterlassen:
Wir können Ihren Zugang aussetzen oder beenden, wenn Sie diese Bedingungen wesentlich verletzen.
Sie behalten das volle Eigentum an jeder musikalischen Eingabe und an jedem von Paintiano erzeugten Gemälde. Wir erheben keine Rechte an Ihren Schöpfungen.
Sie sind verantwortlich dafür, dass Sie das Recht haben, jede hochgeladene Eingabe zu verwenden.
Der Paintiano-Name, das Logo, der Quellcode und das visuelle Design bleiben geistiges Eigentum des Betreibers.
Einige Funktionen („Stimmung" und „Stimmung aus Bild") nutzen KI-Modelle Dritter zum Komponieren von Musik. Die Ausgabe wird automatisch erzeugt und kann gelegentlich unerwartet sein. KI-Kompositionen werden wie besehen bereitgestellt.
Wir stellen den Dienst nach bestem Bemühen bereit. Wir können Teile des Dienstes ändern, aussetzen oder einstellen. Der Dienst wird „wie besehen" bereitgestellt, ohne Gewährleistungen über das zwingende Verbraucherrecht hinaus.
Soweit gesetzlich zulässig ist unsere Gesamthaftung auf den Betrag begrenzt, den Sie uns in den letzten zwölf (12) Monaten gezahlt haben. Wir haften nicht für indirekte oder Folgeschäden.
Nichts beschränkt die Haftung für Betrug, grobe Fahrlässigkeit oder gesetzliche Verbraucherrechte.
Wir erheben minimale Daten: Lizenzschlüssel, Aktivierungs-E-Mail (von Paddle), anonyme Nutzungsanalysen und Support-Korrespondenz. Wir verkaufen Ihre Daten nicht.

Wir können diese Bedingungen aktualisieren. Wesentliche Änderungen werden per E-Mail oder via Banner kommuniziert. Weitere Nutzung gilt als Zustimmung.
Diese Bedingungen unterliegen dem Recht der Slowakischen Republik. Als Verbraucher behalten Sie zwingende Verbraucherschutzrechte Ihres Wohnsitzlandes.
Streitigkeiten können vor dem zuständigen slowakischen Gericht oder über die EU-Online-Streitbeilegungsplattform verfolgt werden.

Quoi qu’il en soit, Paintiano offre volontairement un remboursement intégral de 14 jours à chaque client.
Après remboursement, la clé est désactivée et les fonctionnalités Pro coupées à la prochaine session en ligne.

Nous pouvons suspendre ou résilier votre accès en cas de violation matérielle.
Vous conservez la pleine propriété de toute entrée et peinture générée. Nous ne revendiquons aucun droit sur vos créations.
Vous êtes responsable d'avoir le droit d'utiliser toute entrée téléversée.
Le nom Paintiano, logo, code source et design visuel restent la propriété intellectuelle de l'exploitant.
Certaines fonctionnalités (« Humeur », « Humeur depuis image ») utilisent des modèles IA tiers. La sortie est générée automatiquement et peut être inattendue. Les compositions IA sont fournies telles quelles.
Nous fournissons le Service au mieux. Nous pouvons modifier, suspendre ou interrompre des parties du Service. Le Service est fourni « en l'état », sans garantie au-delà du droit impératif de la consommation.
Notre responsabilité totale est limitée au montant payé pour la Licence dans les douze (12) mois précédents. Nous ne sommes pas responsables des dommages indirects ou consécutifs.
Rien ne limite la responsabilité en cas de fraude, faute lourde, ou droits légaux des consommateurs.

Al usar el Servicio o comprar la Licencia confirmas haber leído, comprendido y aceptado estos Términos. Si no estás de acuerdo, no uses el Servicio.
El Servicio lo opera:

El Servicio es de acceso libre. Cualquiera puede usar Paintiano en su navegador para convertir entradas musicales (MIDI, audio, micrófono o prompts IA) en pinturas generativas y exportarlas. Incluye límites razonables.
Paintiano ofrece dos licencias de por vida de pago único — Paintiano Pro y Paintiano Pro AI. Ambas desbloquean funciones premium durante la vida útil del producto. Pro incluye:

Puedes solicitar un reembolso completo dentro de los 14 días, por cualquier motivo (Directiva 2011/83/UE). Envía correo a hello@paintiano.app o contacta Paddle directamente. Procesado en 5 días hábiles al método de pago original.
Como Paintiano Pro es contenido digital entregado de inmediato, tu derecho legal de desistimiento de la UE puede finalizar antes de 14 días una vez que comienza la entrega y has consentido el acceso inmediato en el pago (consulta los Checkout Buyer Terms de Paddle). Independientemente de esto, Paintiano ofrece voluntariamente un reembolso completo de 14 días a cada cliente.
Tras el reembolso, la clave se desactiva y las funciones Pro se desactivan en la siguiente sesión online.
Te comprometes a no:
Podemos suspender tu acceso si infringes materialmente.
Conservas la plena propiedad de tus entradas y pinturas generadas. No reclamamos derechos sobre tus creaciones.
Eres responsable de tener derecho a usar cualquier entrada subida.
El nombre Paintiano, logo, código fuente y diseño siguen siendo del operador.
Algunas funciones («Estado de ánimo», «Estado de ánimo desde imagen») usan modelos IA de terceros. La salida puede ser inesperada. Las composiciones IA se proporcionan tal cual.
Prestamos el Servicio según nuestro mejor esfuerzo. Podemos modificar o discontinuar partes. El Servicio se presta «tal cual», sin garantías más allá del derecho del consumidor.
Nuestra responsabilidad total se limita al importe pagado en los últimos doce (12) meses. No somos responsables de daños indirectos ni consecuenciales.
Nada limita la responsabilidad por fraude, negligencia grave o derechos legales del consumidor.
Recopilamos datos mínimos: claves emitidas, correo de activación (Paddle), analítica anónima, y correspondencia de soporte. No vendemos tus datos.

Podemos actualizar estos Términos. Los cambios materiales se comunicarán por correo o banner. El uso continuado constituye aceptación.
Estos Términos se rigen por las leyes de la República Eslovaca. Como consumidor conservas los derechos del derecho imperativo de tu país.

Tieto Obchodné podmienky („Podmienky") upravujú vaše používanie webovej aplikácie Paintiano dostupnej na paintiano.app („Služba") a akýkoľvek nákup licencie Paintiano Pro („Licencia").
Používaním Služby alebo zakúpením Licencie potvrdzujete, že ste si Podmienky prečítali, porozumeli im a súhlasíte. Ak nesúhlasíte, Službu nepoužívajte.
Službu prevádzkuje:
Zapísaný v Živnostenskom registri SR; orgán dozoru je príslušný okresný úrad podľa miesta podnikania.
Služba je voľne prístupná. Ktokoľvek môže používať Paintiano v prehliadači na premenu hudobného vstupu (MIDI, audio, mikrofón, AI prompty) na generatívne obrazy a tieto exportovať. Bezplatná verzia má primerané limity.
Paintiano ponúka dve jednorazové doživotné licencie — Paintiano Pro a Paintiano Pro AI. Obe odomykajú prémiové funkcie počas životnosti produktu. Pro zahŕňa:
Pro AI zahŕňa všetko z Pro a navyše odomyká neobmedzenú AI kompozíciu — z textu, z tvojich obrázkov a AI atmosférické tónovanie.
Každá licencia sa doručuje elektronicky vo forme kľúča e-mailom po potvrdení platby. Aktivujete ju zadaním kľúča v Službe.
„Životnosť" znamená dokým Paintiano funguje ako služba. Negarantujeme minimálnu dobu, ale dáme primerané upozornenie pri ukončení.
Ceny sú v EUR vrátane aplikovateľných daní.
Platby spracúva Paddle.com Market Limited ako Merchant of Record. Kúpou tiež súhlasíte s Podmienkami nákupcu Paddle.
Faktúru vystaví Paddle a doručí e-mailom spolu s kľúčom.
Môžete požiadať o plné vrátenie do 14 dní z akéhokoľvek dôvodu (Smernica 2011/83/EÚ). Pošlite e-mail na hello@paintiano.app alebo kontaktujte Paddle priamo. Spracované do 5 pracovných dní na pôvodný spôsob platby.
Keďže Paintiano Pro je digitálny obsah doručený okamžite, vaše zákonné právo EÚ na odstúpenie môže zaniknúť skôr ako za 14 dní, akmile sa doručenie začne a pri platbe ste súhlasili s okamžitým sprístupnením (pozri Checkout Buyer Terms spoločnosti Paddle). Bez ohľadu na to Paintiano dobrovoľne ponúka plné 14-dňové vrátenie peňazí každému zákazníkovi.
Po vrátení sa kľúč deaktivuje a Pro funkcie vypnú pri ďalšom online spojení.
Súhlasíte, že nebudete:
Pri závažnom porušení môžeme pozastaviť alebo ukončiť prístup.
Zachovávate plné vlastníctvo vstupov a vygenerovaných obrazov. Nenárokujeme práva na vaše výtvory.
Ste zodpovední za právo používať akýkoľvek nahraný vstup.
Názov Paintiano, logo, zdrojový kód a vizuálny dizajn zostávajú vlastníctvom prevádzkovateľa.
Niektoré funkcie („Nálada", „Nálada z obrazu") používajú AI modely tretích strán. Výstup je generovaný automaticky a môže byť nečakaný. AI kompozície sú poskytované tak ako sú.
Poskytujeme Službu podľa najlepšieho úsilia. Môžeme upraviť alebo ukončiť časti Služby. Služba je poskytovaná „tak ako je", bez záruk nad rámec spotrebiteľského práva.
Naša celková zodpovednosť je obmedzená na sumu, ktorú ste nám zaplatili v posledných dvanástich (12) mesiacoch. Nezodpovedáme za nepriame ani následné škody.
Nič neobmedzuje zodpovednosť za podvod, hrubú nedbanlivosť alebo zákonné práva spotrebiteľa.
Zbierame minimálne dáta: licenčné kľúče, aktivačný e-mail (Paddle), anonymnú analytiku a korešpondenciu. Vaše dáta nepredávame.

Môžeme aktualizovať Podmienky. Podstatné zmeny oznámime e-mailom alebo bannerom. Pokračovanie v používaní znamená súhlas.
Tieto Podmienky sa riadia zákonmi Slovenskej republiky. Ako spotrebiteľ zachovávate práva podľa povinného spotrebiteľského práva svojej krajiny.
Spory môžu byť predložené príslušnému slovenskému súdu alebo cez platformu ODR EÚ.

Independentemente disso, o Paintiano oferece voluntariamente um reembolso completo de 14 dias a cada cliente.
Após reembolso, a chave é desativada e recursos Pro desligados na próxima sessão online.
Você concorda em não:
Podemos suspender seu acesso em caso de violação material.
Você mantém plena propriedade de entradas e pinturas geradas. Não reivindicamos direitos sobre suas criações.

O nome Paintiano, logotipo, código-fonte e design permanecem propriedade do operador.

Nossa responsabilidade total é limitada ao valor pago nos últimos doze (12) meses. Não somos responsáveis por danos indiretos ou consequenciais.
Nada limita responsabilidade por fraude, negligência grave ou direitos legais do consumidor.

本サービスは無料で利用できます。誰でもブラウザ上で Paintiano を使い、音楽入力（MIDI ファイル、オーディオ、マイク入力、または AI 生成のムードプロンプト）を生成的な絵画に変換し、画像としてエクスポートできます。無料版にはサーバーコスト管理のための合理的な利用上限が含まれます。
Paintiano は一度きりの買い切り型の生涯ライセンスを 2 種類提供します — Paintiano Pro と Paintiano Pro AI。どちらも製品の存続期間中、サービスのプレミアム機能を解放します。Pro には以下が含まれます（ただしこれらに限りません）：
Pro AI は Pro のすべてを含み、さらに無制限の AI 作曲 — テキストから、あなたの画像から、そして AI アトモスフェリック・ティント — を解放します。
各ライセンスは、決済処理業者による支払い確認後ただちに、ライセンスキーとして電子的にメールで届きます。このキーをサービス内に入力してライセンスを有効化します。

支払いは、記録上の販売者（Merchant of Record）として行動する決済プロバイダー Paddle.com Market Limited によって処理されます。ライセンスを購入することにより、Paddle の 購入者向けチェックアウト規約 にも同意したことになります。
購入請求書は Paddle によって発行され、ライセンスキーとともにメールで届きます。
EU 消費者法（指令 2011/83/EU）に従い、購入後 14 日 以内であれば、理由を問わず全額返金を請求できます。返金をご希望の場合は、購入に使用したアドレスから hello@paintiano.app へメールするか、Paddle サポートに直接ご連絡ください。返金は通常、元の支払い方法に対して 5 営業日以内に処理されます。
Paintiano Pro はただちに提供されるデジタルコンテンツであるため、提供が開始され、決済時に即時アクセスに同意した時点で、EU 法に基づく法定の撤回権は 14 日より前に終了する場合があります（Paddle の Checkout Buyer Terms を参照）。これにかかわらず、Paintiano はすべてのお客様に 14 日間の全額返金を自主的に提供します。

当社はベストエフォートでサービスを提供します。バグ修正、機能追加、または運用上の理由により、サービスの一部を変更、停止、または終了することがあります。短時間の計画的または非計画的な停止が発生する場合があります。サービスは、強行的な消費者法で求められるものを超える保証なしに 「現状有姿」 で提供されます。

本規約は スロバキア共和国 の法律に準拠します。消費者として行動する場合、あなたの居住国の強行的な消費者保護法が付与する権利も引き続き保持します。
紛争はまず誠実なコミュニケーションを通じて対処されます。解決しない場合、紛争は管轄のスロバキアの裁判所に、または消費者紛争については EU の オンライン紛争解決プラットフォーム を通じて提起できます。
